Die Nachricht verbreitet sich aktuell wie ein Lauffeuer im Netz. WhatsApp-Nutzer treten ihre Bildrechte ab, sobald sie diese über den Dienst verschicken.
Nachrichten, Bilder, Videos, Positionsdaten und Sprachnotizen können über den beliebten Messenger verschickt werden. Jetzt wird dieser durch seine AGB erneut an den Pranger gestellt und die Abtretung der Rechte verdeutlicht.
In den AGB steht unter Punkt 5 (User Status Submission) im Abschnitt B unter „ii“ folgendes dazu:
„[…]and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the Status Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the Status Submissions in the manner contemplated by the Service and these Terms of Service. To be clear: you retain all of your ownership rights in your Status Submissions, but you have to have the rights in the first place. However, by submitting the Status Submissions to WhatsApp, you hereby grant WhatsApp a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Status Submissions in connection with the WhatsApp Service and WhatsApp’s (and its successor’s) business, including without limitation for promoting and redistributing part or all of the WhatsApp Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each subscriber to your status on the WhatsApp Service a non-exclusive license to access your Status Submissions through the Service. The foregoing license granted by you terminates once you remove or delete a Status Submission from the WhatsApp Service.“
Das Urheberrecht bleibt also bestehen und nur das Nutzungsrecht wird abgetreten. Somit kann WhatsApp diese übermittelten Inhalte und Medien weiterverwenden und diese sogar zu verkaufen. Aha, das Urheberrecht bleibt also beim jeweiligen Nutzer, aber wenn das Urheberrecht eigentlich gar nicht bei ihm liegt, sondern bei einem anderen? Aber das ist wieder ein Thema für sich, was in welchem Fall wie wo abgemahnt werden kann.
Viel eher geht es darum, dass solche kostenlosen Dienste immer mit einem gesunden Menschenverstand genutzt werden sollte. Bekannt ist nicht inwiefern WhatsApp hier das gesammelte Material bisher verwendet und ob dies überhaupt der Fall ist. Spannend bleibt dieses Thema dennoch und sicher dürfte der ein oder andere „Fall“ in naher Zukunft ans Tageslicht kommen.
